ANJANA MISHRA ORAL ORDER 09-02-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 03.11.2015 in connection with Bijayeepur P.S. Case No. 17 of 2015, registered for offences punishable under Sections 273, 272, 414 of the Indian Penal Code and Section 47(a) of the Excise Act. Learned counsel for the petitioner submits that neither the petitioner has been apprehended at the spot nor anything has been recovered from his conscious possession. It is further submitted that the petitioner has been dragged in the present case merely on suspicion and no offence under Section 47(a) of the Excise Act is being made out against him.

Considering the aforementioned facts and

Patna High Court Cr.Misc. No.3785 of 2016 (2) dt.09-02-2016 2/2 circumstances and also the fact that the petitioner is languishing in jail custody since 03.11.2015, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Aashish Mishra, learned Judicial Magistrate, 1st Class, Gopalganj, in connection with Bijayeepur P.S. Case No. 17 of 2015.
