JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-01-2020 This is an application for grant of anticipatory bail in connection with Turkauliya P.S. Case No.483 of 2019, disclosing offence under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per F.I.R., there is allegation that police got information that petitioner is selling illicit liquor. On that information police reached there but the person who selling the liquor succeeded in fleeing away and there is recovery of 42 liters of illicit liquor.

Submission of learned counsel for the petitioner is that nothing has been recovered from his conscious possession, or from his house or at his instance. He has no criminal

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Additional Sessions Judge-IX-cum-Special Judge, Excise, East Champaran, in connection with Turkauliya P.S. Case No. 483 of 2019. (Vinod Kumar Sinha, J) Rahul/- U T
