The petitioner seeks bail in Mansoorchak P.S. Case No. 92 of 2013, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code. The informant alleged that the petitioner and his wife, Ruko Devi took Sudhir Mahton to Korai Badiya at the auto rikshaw of Sachit Mahton and kept him in his house. At about 3 am Dr. Manoj Das treated Sudhir Mahton. It is further alleged that Kapildeo Mahton, Pankaj Mahton (petitioner) and wife of Pankaj Mahto took Sudhir Mahton on the auto rickshaw for his treatment. It is submitted that Sudhir Mahton fell down from the auto-rickshaw and got injury on the head. The petitioner took him to Narhan where the doctor declared him dead. Thereafter the

Had the petitioner assaulted the deceased or he would have not brought the dead body in the house of the deceased. Co-accused, namely, Sachit Mahton and Kapildeo Mahton has already been enlarged on bail. Petitioner is in jail since 17.12.2014 and the police after investigation submitted charge-sheet under Section 304 of the Indian Penal Code.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Begusarai in connection with Mansoorchak P.S. Case No. 92 of 2013.
