JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 05-08-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Amas P.S. Case No. 136 of 2021, registered for the offences punishable under Sections 420, 428,429, 414,120 (B)/34 of the Indian Penal Code and Section 3,4, 11 (a) (d) (h) (k) of Bihar Animals Protection Act, 1960 and Section 4 of the Bihar Protection to Animals Act, 1955.

The informant of this case is Anil Kumar Singh, S.I., Amas police station. As per prosecution case, police got confidential information that two groups of different communities are fighting for keeping the cattle. On the basis of said information the informant

Patna High Court CR. MISC. No.2874 of 2022(2) dt.05-08-2022 2/2 reached at village Hamzapur and found two containers of cattle at G.T. Road. The containers were overloaded with cattle. Learned counsel for the petitioner has submitted that petitioner is a person of clean antecedent. He is merely a driver of the container and one Ram Lakhan Yadav who is owner of the consignment had purchased the cattle from fair. Considering the above-mentioned facts and circumstances as well as the clean antecedent of the petitioner, let him, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs.

10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Sherghati, Gaya in connection with Amas P.S. Case No. 136 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
