JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-05-2015 Petitioner is languishing in custody since 14.01.2015 in a case registered for the offences punishable under Sections 364, 302, 201, 120B, 34 of the Indian Penal Code.

The brother of the informant went to market on 23.09.2010 at about 1:00 P.M and thereafter he went missing. Subsequently his dead body was recovered near Kiul river. The name of the petitioner sprang up during investigation when spy of the police raised suspicion against the petitioner. It is submitted by learned counsel for the petitioner that only on suspicion the petitioner has been roped in the present case.

Learned A.P.P, after going through the case diary submits that suspicion has been raised against the petitioner in commission of the crime.

Considering the fact that investigation has

No.8501 of 2015 (4) dt.22-05-2015 2/2 concluded, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 260 of 2010.

Since the petitioner is accused in five other cases and in a case registered in the year 2010, the petitioner was arrested in the year 2015, let learned Court below cancel the bail bonds of the petitioner, if the petitioner gets substantially involved in serious nature of offence or defaults for two consecutive occasions during trial.
