JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 24-12-2021 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State, Sharda Kumari. The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month. The petitioner apprehends his arrest in connection with Banka P.S. Case No. 78 of 2018 registered for offence punishable under sections 354A, 354D, 504 and 506 of the Indian Penal Code. The allegation against the petitioner is that he is continuously harassing the wife of the informant by sending unwanted messages and making telephonic calls on her mobile number. There is also allegation that some another person has threatened her on her cell phone.

The learned counsel for the petitioner has submitted that no vulgar talk has been taken place between the petitioner and

Considering the above mentioned facts and circumstance of the case, let the petitioner above named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 78 of 2018, subject to condition as laid down under section 438(2) Cr. P.C. Further condition is that at the time of surrender, the petitioner shall furnish an affidavit that he will not indulge in such type of occurrence in future. If such type of occurrence takes place in future, the court below shall cancel the bail bond. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
