JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-09-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in connection with Muzaffarpur Complaint Case No. 2187 of 2016, for the offence under Sections 323, 406, 354(B), 498(A)/34 and 120(B) of the Indian Penal Code besides Sections 3 and 5 of the Immoral Traffic Prevention Act, 1956, pending in the Court of learned Sub-Divisional Judicial Magistrate, East Muzaffarpur.
Learned counsel appearing on behalf of petitioner submits that, in fact, due to non-communication of the order, the petitioner could not surrendered before the trial Court for
Patna High Court CR. MISC. No.4719 of 2020(2) dt.08-09-2021 2/2 settlement of dispute between petitioner and O.P. No.2, who are husband and wife due to that reason, the pre-arrest bail of the petitioner was refused earlier on 29.07.2019 passed in Criminal Miscellaneous No. 8691 of 2019.
The prayer for pre-arrest bail of the petitioner was rejected earlier on 29.07.2019 by this Court vide Criminal Miscellaneous No. 8691 of 2019. As such, I find no reason to re-consider the prayer for pre-arrest bail of the petitioner. Accordingly, prayer for pre-arrest bail of the petitioner is again rejected.
