The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 337, 504 of the Indian Penal Code and Sections 25(1b)a, 26, 27 and 35 of the Arms Act Learned counsel for the petitioner submits that the petitioner is a person with one antecedent and is a woman and informant alleges that on orders of petitioner accused Dheeraj and Munna fired but missed.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that from bare perusal of the allegation as alleged in the FIR it would manifest that the informant alleges
Patna High Court CR. MISC. No.9332 of 2023(2) dt.07-07-2023 2/2 that the petitioner alongwith other accused persons after filing nomination was coming when it is alleged that they started raising slogan in front of the house of the informant and on objection the firing was made on her orders.
It is next submitted that the dispute is completely political and no injury was suffered by any persons. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Harnaut P.S. Case No. 497 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
