The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 447, 341, 323, 324, 325, 307, 379, 354, 504, 506 of the Indian Penal Code.

The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that on 18.05.2021 at about 6.00 A.M., she was doing domestic work in her house when all the accused persons came and started abusing the informant and even

It is next alleged that on orders of Jai Krishan Yadav, Shambhu Yadav gave dabiya blow on the head of the husband of the informant causing injury and when the informant went to save her husband, Shambhu Yadav caught her hair and pushed her on the ground on account of which, she became semi-naked. Thereafter, petitioner no.2 is alleged to have assaulted Nisha Kumari by horse bridle on head causing injury and Ashutosh Yadav assaulted Amlesh Yadav by axe on his head. It is alleged that all the injured were referred to the hospital. The learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case.

It is next submitted that specific allegation of assaulting Mano Yadav is on Shambhu Yadav. Further, Mano Yadav had received grievous injury. It is next submitted that no specific overt act has been alleged against petitioner nos.1 and 3 and as far as petitioner no.2 is concerned, he is alleged to have assaulted Nisha Kumari by horse bridle causing injury on head, but the injury is simple in nature.

Learned A.P.P. opposes the bail application.

Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the

Patna High Court CR. MISC. No.2673 of 2022(2) dt.10-08-2022 3/3 event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Rupauli (Mohanpur O.P.) P. S. Case No.72 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
