BAJANTHRI) Date : 07-07-2022 Heard learned counsel for respective parties. In the instant appeal, appellant has assailed the order of the learned Single Judge dated 06.12.2018 passed in CWJC No. 19792 of 2018. The appellant while working in Middle School Khandakpur Biharsharif, transferred to Middle School, Maniyama, Silao. Thereafter, appellant submitted representation and on her request she was posted to Middle School Ramjichak, Biharsharif which was subject matter of litigation in CWJC No. 19792 of 2018.

Transfer of an employee is in accordance with the relevant regulation or transfer policy matter. Employee has no right to claim and sit in a particular post or place as held by

Patna High Court L.P.A No.65 of 2019 dt.07-07-2022 2/2 the Apex Court time and again. It is for the employer to decide to post its employee to where and to which place. He or she is the best person to assess an employee to be posted in which place and where and how to extract work. Therefore, the appellant has not made out a case so as to interfere with the order of transfer read with order of the learned Single Judge dated 06.12.2018 passed in CWJC No. 19792 of 2018. Accordingly, the Letters Patent Appeal stands dismissed.
