Although petitioner is named in the first information report but it appears that petitioner happens to be cousin brother of the deceased and there was serious litigation between the parties. Informant is not an eye-witness of the alleged occurrence nor any witness claimed to have seen the actual killing of the deceased and except suspicion, there is nothing against the petitioner. No doubt, enmity cuts both ways but in the present case, investigation has already been completed and except suspicion, Investigating officer could not succeed to collect any material against the petitioner.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar
