2. The petitioners have prayed for bail in a case instituted for the offence under Sections 302, 201/34 of the Indian Penal Code.

3. It is a case of commission of murder to the informant's son, namely, Mantu Singh by the accused persons hitting his head by sharp cutting weapon and his dead body was found hidden in the land of Dinesh Singh

4. It is submitted by learned counsel for the petitioners that petitioners have been falsely implicated in this case. No one is the eye witness of the alleged occurrence. Only on the basis

Patna High Court CR. MISC. No.4436 of 2024(2) dt.08-02-2024 2/2 of suspicion, the name of the petitioners have been dragged in the present case. Petitioners are not named in the FIR. During investigation, no consistent material has come against the petitioners to show their involvement in the present case. His dead body was recovered from the field of accused Dinesh Singh, who had already been granted bail by another co-ordinate Bench of this Court vide order dated 27.09.2022 passed in Cr. Misc. No. 29747 of 2023. Petitioners are languishing in judicial custody since 26.7.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Munger in connection with Harinmar P.S. Case No. 18 of 2020.
