The petitioner has preferred this application for grant of regular bail in a case registered under sections 328 and 34 of the Indian Penal Code.
As per allegations in the FIR, the accused persons including the petitioner herein are stated to have tortured the daughter of the informant for non-fulfillment of the demand of dowry and ultimately as per information received she consumed poison and died.
It is submitted by learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in the case because of his relationship of being the husband of the deceased. No incriminating material has transpired in course of
Patna High Court CR. MISC. No.11873 of 2021(4) dt.07-09-2021 2/2 investigation. Even in course of trial the four witnesses examined on behalf of the prosecution have all turned hostile. The petitioner is in custody since 19.3.2019. Heard learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner in the FIR together with the trial in the case having proceeded, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
