Considering the submission made by the learned counsel for the petitioner and the submission made in the present M.J.C. application, the present petition is allowed and the aforesaid CWJC No. 3801 of 2018 is restored to its original file.

It is submitted that there is no retained counsel for the respondent no.2 in the High Court, hence the requirement of serving copy on the respondent no.2 be waived. Prayer is allowed.
