Having heard learned counsel for the applicants and learned counsel for the State of Bihar, we are satisfied that the affidavit discloses sufficient cause for not having attended the case on the date when the same was dismissed in default. We, accordingly, allow the restoration application, recall the order dated 20.11.2017 and restore the Letters Patent Appeal No. 761 of 2016 to be heard on merit. It shall be listed before the appropriate Bench accordingly.
