JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 29.04.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Earlier prayer for bail of the petitioner was thrice rejected and taking note of his fact that there is allegation of firing against the petitioner and he evaded his arrest for near about nine years, I am, again, not at all agree to review his prayer for bail and accordingly, his prayer for bail in connection with Sessions Trial no. 41 of 2014/ 40 of 2012 arising out of Atri P.S. Case no. 13/2000 pending in the court of Addl. Sessions Judge VI, Gaya stands rejected. However, the learned trial court is directed to conclude the trial of the petitioner within six months from the date of receipt/production of a copy of this order as the petitioner is languishing in jail custody since 16.12.2009, failing which the petitioner shall be entitled to renew his prayer for bail before trial court itself.

Patna High Court Cr.Misc. No.15235 of 2015 (3) dt.29-04-2015 Let a copy of this order be sent to Superintendent of Police, Gaya with direction to him to ensure presence of remaining prosecution witnesses of the above stated sessions trial before Addl. Sessions Judge VI, Gaya within three months from the date of receipt/production of a copy of this order, failing which matter shall be viewed seriously.
