The petitioner seeks bail in a case registered for offences under Sections 420, 467, 468, 471 and 120B/34 of the Indian Penal Code and Sections 30A, 38 and 41 of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, huge quantity of foreign liquor was recovered from the truck and the petitioner is said to be the "Khalasi" of the said truck. It is contended that the petitioner was not having specific information as to what is the nature of consignment
Patna High Court Cr.Misc. No.56275 of 2017(2) dt.23-11-2017 2/3 which was loaded in the truck and was also not knowing as to whether carrying such consignment was an offence as he was merely a "Khalasi". It is further contended that the co-accused Amar Veer Singh, who was driver of the said truck, has been granted bail by a Co-ordinate Bench of this Court vide order dated 17.11.2017 passed in Cr. Misc. No. 55386 of 2017. It is urged that the petitioner has remained in custody since 15.04.2017, i.e., for about more than seven months. It is claimed that the petitioner is having clean antecedent. Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.
10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Patna in connection with Special Case No. 1132 of 2017 arising out Economic Offence P.S. Case No. 6 of 2017 with a condition that one of the bailors of the petitioner(s) must be the close relative or his family member, who will file affidavit before the court below giving full genealogy showing his or her relationship with the petitioner and the other bailor shall be the resident of Bihar since the petitioner belongs to Punjab.
Patna High Court Cr.Misc. No.56275 of 2017(2) dt.23-11-2017 3/3 case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
