JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 06-01-2022 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioners as well as the learned APP for the State.

The petitioners apprehend their arrest in connection with Suppi P.S. Case No. 219 of 2020, registered for the offences punishable under Sections 363, 366/34 of the Indian Penal Code. Informant, Satya Devi, lodged an FIR against accused persons for kidnapping her minor daughter Arti Kumari. The victim Arti Kumari was recovered and her statement under Section 164 of the Cr.P.C. was recorded. The learned Magistrate has assessed her age as 18 years. Whereas the victim has

Patna High Court CR. MISC. No.12012 of 2021(3) dt.06-01-2022 2/2 stated her age as 20 years. She has stated that she was in love and affection with co-accused Ratnesh Kumar and he has solemnized marriage with her on 03.09.2020 in court.

The present petitioners are parents of co-accused Ratnesh Kumar with whom the alleged victim has solemnized her marriage. Considering these facts and circumstances, let the petitioners be released on bail in the event of their arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi/concern court in connection with Suppi P.S. Case No. 219 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
