Petitioner is named in the first information report but according to the prosecution case itself, it was co-accused Pappu Sahni who shot fire on the deceased.

Moreover, from perusal of the impugned order, it appears that after due investigation, police submitted final form in respect of the petitioner but learned Chief Judicial Magistrate differed with the finding of the police and took cognizance against the petitioner also. Petitioner does not have any criminal antecedent. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in Minapur (Panapur O.P) P.S.
