Writ application is dismissed for the reason that the appointment and selection related to the advertisement of the year 2004. It is too late in the day to consider passing any direction for consideration, even if the argument of the petitioner is accepted that the reason for rejection of his candidature on medical ground may not be for the correct reason, which is not clear from the medical board's report.
The Court, however, does opine that the Director General of Police must ensure that whenever medicals are held, the reason for rejection on medical
Patna High Court CWJC No.11164 of 2008 dt.13-08-2015 2/2 grounds must use medical terminology in specifics, the generality of opinion may be indicated thereafter. This must be ensured for all future cases of selection and appointment and when medical is required to be held. A copy of the order will be communicated to DG, Police, Government of Bihar for appropriate direction and remedial measure.
Writ application stands dismissed with observation / direction as above.
