The petitioner, being the mother-in-law of the deceased, who is in custody since 19.8.2014 on surrender in connection with Mahila Police (Bhabua) P.S. Case No.24 of 2013, registered for the offences under Sections 304B of the Indian Penal Code, has made prayer for bail on the ground that the husband of the deceased and brother-in-law (Dewar) have already been acquitted in connection with the present case by the court of Additional District & Sessions Judge- III, Kaimur at Bhabua. Learned counsel for the petitioner submits that so far as the petitioner is concerned, it is evident from the F.I.R. that there is general and omnibus allegation against all the accused persons
Patna High Court Cr.Misc. No.12587 of 2015 (2) dt.27-05-2015 2/2 and the husband of the deceased and Dewar have been acquitted in Sessions Case No.345/14-4854/14 in connection with the present case.
Considering the aforementioned submissions and also the period of custody, let the above named petitioner be released on bail on her furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 3rd, Kaimur at Bhabua, in connection with Sessions Trial No.67 of 2015/18 of 2015, arising out of Mahila Police (Bhabua)P.S. Case No.24 of 2013.
