JUSTICE SUDHIR SINGH ORAL ORDER 10-06-2015 The petitioner is languishing in custody since 07.02.2015 in connection with Complaint Case No. 478 of 2014 for the offences instituted under Sections 498(A), 494, 504, 323 of the I.P.C. and Section 4 of the D. P. Act.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that within one year of marriage of the complainant with Deepak Das, during her stay in her matrimonial home, the petitioner alongwith others subjected her to cruelty for fulfillment of dowry demand and on one occasion during her beating her one tooth was broken. As per the complaint, Deepak Das has remarried with another lady. On

Patna High Court Cr.Misc. No.15928 of 2015 (2) dt.10-06-2015 2 / 2 06.06.2014 after inquiry the proceeding has been initiated against three accused under Sections 498(A) of the I.P.C. and 4 of the D. P. Act.

It has been submitted on behalf of the petitioner that the petitioner is ready to keep the complainant but she is not ready to stay with the petitioner. Further it has been submitted that the petitioner is ready to deposit Rs. 1500/- per month in the court below which may be released in favour of the complainant. On behalf of the State, it has been submitted that the petitioner is the husband of the complainant and he is named in the F.I.R.

Considering the aforesaid facts and circumstances, the petitioner is directed to deposit amount of Rs. 1500/- per month in the court below which shall be released in favour of the complainant, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Banka, in connection with Complaint Case No. 478 of 2014.
