JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 28-01-2019 Learned counsel for the petitioner has placed before this Court that the impugned order was passed without considering the reply of the petitioner. It is submitted that the Sub-Divisional Officer had given 24 hours only to submit the reply which cannot be said to be an adequate opportunity. In view of the statements made in Paragraph 12 of the writ application stating that the petitioner has preferred an appeal before the Collector, Banka in E.C. Appeal No. 06/200910, this writ application is being disposed of with a direction to the Collector, Banka to consider and dispose of the aforesaid appeal within a period of 60 days from the date of receipt/production of a copy of this order. Patna High Court CWJC No.1396 of 2019(2) dt.28-01-2019 2/2 shall keep in mind that the impugned order is of the year 2009 and the appeal was required to be disposed of within 60 days which is pending for last 10 years. It does not speak well about the efficiency of the office.

All the aforesaid issues shall be considered by the appellate authority.
