The petitioner is in custody in connection with Excise Case No. 157 of 2018 corresponding to P.R. No. 26 for the offences under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 24.11.2018. He further submits that in the instant case petitioner and four other persons were shown as accused persons who fled away from the place of occurrence. The Court has granted bail of Jitendra Rai @ Jitendra Kumar Rai @ Jitendra Kumar in Cr. Misc. No. 77356 of 2018 vide order dated 11.01.2019.

Patna High Court Cr.Misc. No.2665 of 2019(2) dt.21-01-2019 2/2 Considering the fact that the case of the petitioner is similar to that of Jitendra Rai @ Jitendra Kumar Rai @ Jitendra Kumar, the Court is inclined to grant bail to the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Special Judge, Excise, Muzaffarpur in connection with Excise Case No. 157 of 2018 corresponding to P.R. No. 26.
