2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 120(b), 201/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, this petitioner along with other co-accused persons got released two accused persons from police custody who were involved in liquor smuggling.

4. Learned counsel for the petitioner submits that petitioner in innocent and has falsely been implicated in this case. As a matter of fact, on the instruction of SHO, Rail thana, Bhabua, this petitioner released the accused persons on PR bond and as such, petitioner has committed no offence . Petitioner

Patna High Court CR. MISC. No.905 of 2025(3) dt.15-04-2025 2/2 claims clean antecedent. Similarly situated co-accused persons have already granted bail by this Court vide order dated 15.02.2025 in Cr. Misc. No. 2723 of 2025 .

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the aforesaid facts and circumstances of the case , this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Excise Judge No. 2, Gaya in connection with Rail (Bhabhua Road) P. S. Case No. 06 of 2024 , subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure . (Prabhat Kumar Singh, J) Koushik/- U T
