The petitioner is in custody in connection with Gogri P.S.Case No.308 of 2017 registered for an offence under Section 307 and ancillary Sections of the IPC.

This petitioner and husband of the informant are full brothers. It is alleged that a land dispute is pending and the entire family members have been implicated in this case. It is alleged that altogether 15 persons who are agnates of the husband of the informant and her son have been implicated in this case. The allegation of assault by lathi and dabia is against Udai Singh, Amit Singh and Haritesh Kumar. Out of them, Haritesh Kumar has been allowed bail by one of the coordinate Bench of this Court in

Patna High Court Cr.Misc. No.60725 of 2017 (2) dt.20-12-2017 2/2 Cr.Misc.No.47582 of 2017. The allegation of assault is omnibus against this petitioner. He further submits that the petitioner is in custody since 08.10.2017 having clean antecedent except one case which is registered for the offence under Sections 323 and 379 of the IPC in which the petitioner is on bail.

The learned APP opposed the submissions.

Considering the land dispute between the parties who are descendants of common ancestors and omnibus allegation of assault, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate-Ist Class, Khagaria, DistrictKhagaria in connection with Gogri P.S.Case No.308 of 2017.
