ANJANA MISHRA ORAL ORDER 15-05-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is in custody since 22.1.2015 in connection with Sursand P.S. Case No.37 of 2014, registered for the offences under Section 394 of the Indian Penal Code. Learned counsel for the petitioner submits that the present case under Section 394 of the Indian Penal Code was lodged against unknown persons. It is further submitted on behalf of the petitioner that subsequently one Shiv Shankar Mahto was taken into custody and on his confessional statement, name of the petitioner has surfaced. Learned counsel for the petitioner submits that said Shiv Shanakar Mahto and one Bhola Rai have been extended the privilege of bail by this

Patna High Court Cr.Misc. No.12740 of 2015 (2) dt.15-05-2015 2/2 Court, vide order dated 25.3.2015, passed in Cr.Misc. No.50274 of 2014. It is further submitted that the petitioner has no criminal antecedents.

Considering the aforementioned submissions, let the above named petitioner be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Pupri at Sitamarhi, in connection with Sursand P.S. Case No.37 of 2014.
