The petitioner seeks bail in Baikunthpur P.S. Case No. 92 of 2012, registered for the offences punishable under Sections 364 and 34 of the Indian Penal Code and Sections 3(i)(x) of the S.C./S.T. (Prevention of Atrocities) Act.
The informant made allegation that the Santosh Pandey, Raj Kishore Pandey and Ram Sewak Pandey @ Master Pandey took her son Kashinath Ram to Mumbai for providing job in the month of November, 2009. When the informant went to enquire about her son, then the accused persons abused her by naming her caste and also assaulted her.
Learned counsel for the petitioner submits that the informant filed the Complaint Case No. 33 of 2012 against
Patna High Court Cr.Misc. No.10904 of 2015 (2) dt.18-03-2015 2/2 Santosh Pandey and Raj Kishore Pandey in which the petitioner is not made accused. In the complaint petition the informant alleged that the occurrence took place in the month of September, 2009. The entire allegation is false. The son of the informant went himself somewhere else to get employment. The petitioner is in jail since 29.01.2015.
Considering the facts aforesaid and nature of allegations made against the petitioner, he above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Baikunthpur P.S.
