JUSTICE BIRENDRA KUMAR ORAL ORDER 03-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 20, 22 and 23 of the N.D.P.S. Act. FIR is vague that out of possession of two persons 8.8 Kilograms of Ganja was recovered. Co-accused Ajay Raut stated before the police that recovery was from his possession and the petitioner stated before the police that recovery was from possession of Ajay Raut. The petitioner is in custody since 17.06.2016 and has stated on oath that he has got no criminal antecedent.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-

Patna High Court Cr.Misc. No.40045 of 2016 (6) dt.03-05-2017 (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Sitamarhi/Successor Court, in connection with Parihar P.S. Case No.83 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
