The petitioner is seeking anticipatory bail in connection with Kasma P.S. Case No. 90/2018 registered under Sections 30(a) of the Bihar Excise Act pending in the court of learned Additional Sessions Judge - VII - cum - Special Judge (Excise), Aurangabad.

It appears that on perusal of the records that the petitioner is said to be the owner of the motorcycle which was intercepted by the patrolling party and in course of search 31 liters of alleged illicit liquor has been recovered. Learned counsel for the petitioner submits that petitioner has got no criminal antecedent but this court is not willing to extend the benefit of anticipatory bail to the petitioner for the reason that the motorcycle which has been seized with

Patna High Court Cr.Misc. No.4074 of 2019(2) dt.05-02-2019 2/2 31 liters of illicit liquor is said to be that of the petitioner. In case, the petitioner surrenders in the court below within a period of four weeks from today and prays for regular bail, the same shall be considered on it's own merit without being prejudiced by the orders of this court. This application is disposed of accordingly.
