2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a), 41 (1) of Bihar Prohibition and Excise Act 2022 .

3 . It is alleged that 339.87 liters of English wine was recovered from 12 bags from an open place and it is further alleged that this petitioner alongwith other co-accused persons fled away from the spot after seeing police party .

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion . No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery . Petitioner claims clean

5 . Learned counsel for the State opposes the bail petition .

6. Considering the facts of the case , clean antecedent of the petitioner, in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 3 Civil Court East Champaran at Motihari in connection with RajePur Police Station Case No. 207 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of BNSS 2023 .
