====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 30-01-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Hathidah P.S. Case No. 47 of 2017, instituted for the offence under Section(s) 379 of the Indian Penal Code.

Counsel for the petitioner submits that there is no recovery from conscious possession of the petitioner. No Test Identification Parade has been held. The name of petitioner has come in the confessional statement of co-accused Uchit Paswan who has already been granted bail by coordinate Bench of this Court vide order dated 2.7.2018 passed in Cr. Misc. 36218 of 2018.

Petitioner is in custody since 20.6.2018.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.3626 of 2019(2) dt.30-01-2019 2/2 the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Deepak Kumar, learned Additional Chief Judicial Magistrate, Barh, in connection with Hathidah P.S. Case No. 47 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
