JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-03-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Hisua P.S. Case No. 464 of 2019 registered for the offence punishable under Section 30(a) of Bihar Prohibition & Excise Act.

Since the alleged recovery has been made from the house of the petitioner, in my view, this anticipatory bail petition is not maintainable. Accordingly, this anticipatory bail petition stands dismissed being not maintainable.

However, if petitioner surrenders and seeks regular bail within six weeks from today, the concerned court shall consider the regular bail application of the petitioner on its own

Patna High Court CR. MISC. No.5195 of 2020(2) dt.03-03-2020 2/2 merit without being prejudiced by this rejection order keeping in mind the quantity of recovery made from the house of the petitioner.
