In this case, the petitioners are seeking anticipatory bail in connection with Aurangabad (Town) P.S. Case No. 99 of 2018, registered for the offence punishable under Sections 147, 148, 149, 337, 323, 435, 436, 427, 307, 332, 333, 353, 153(A), 295(A), 122(B) and 379 of the Indian Penal Code.
Patna High Court Cr.Misc. No.3179 of 2019(2) dt.24-01-2019 2/3 Allegation has been made that on the day of Ram Navami procession, the people have assembled in the said procession, but at the later stage, the mob started raising offensive slogans against the different communities and also indulged in vandalism, led to lodging of several criminal cases, out of which the petitioners have been made accused in six cases.
Learned counsel for the petitioners submits that except the cases lodged on that day, the petitioners have no criminal antecedent.
Looking to the entire facts and circumstances of the case, let the above-named petitioners, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad (Town) P.S. Case no. 99 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. Further condition is that whenever the police will call the petitioners for the purposes of investigation and interrogation, they will remain present for the
Patna High Court Cr.Misc. No.3179 of 2019(2) dt.24-01-2019 3/3 investigation. In the event of being absent on two consecutive dates without reasonable explanation, the present order will be treated to have been cancelled.
