The petitioner seeks bail in a case registered under Sections 376(2)(1)(n) of the Indian Penal Code. Allegation is that the petitioner developed physical relationship with the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 08.11.2018 and has got no criminal antecedent. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. Petitioner has falsely been implicated in the present case. The petitioner is alleged to be the Devar of the informant. As per the allegation, the petitioner had physical relationship with the informant since 2011. The petitioner got

Patna High Court CR. MISC. No.5969 of 2019(3) dt.18-04-2019 2/2 married in the year 2018. After the marriage, the informant has come with complaint case, which was registered as F.I.R. under Section 156(3) of Cr.P.C.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VI, Gopalganj in connection with Sidhwaliya P.S. case No.153 of 2018.
