====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 21-01-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Motihari Town P.S. Case No. 737 of 2018, instituted for the offence under Section(s) 413 and 414 of the Indian Penal Code. Counsel for the petitioner submits that name of this petitioner has been disclosed by Rajan Prasad who was apprehended by the police.

It is alleged in the written report that Police got information that two miscreants came with stolen Motorcycle and are trying to sell the same. The informant along with police personnel reached the place of occurrence and found two persons standing near the alleged Motorcycle. On seeing the

Patna High Court Cr.Misc. No.2648 of 2019(2) dt.21-01-2019 2/2 police party, they tried to run away. One person was apprehended by the police on chase who disclosed his name as Rajan Prasad. Another person managed to run away. Rajan Prasad disclosed the name of petitioner.

Petitioner is in custody since 21.10.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Motihari Town P.S. Case No. 737 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
