JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier the prayer for bail of the petitioner was rejected by this Court but again the bail is sought for on two grounds firstly, the trial of the petitioner has not been concluded thought he is in jail custody since long and secondly having similar allegation co-accused Ranjit Kumar Yadav@ Gubber has already been granted privilege of bail by this Court vide order dated 15.04.2015 in Cr. Misc. No. 14385 of 2015.

The trial court has reported that the charges were framed in session trial no. 686 of 2014 arising out of Gardanibagh P.S.Case No. 61 of 2014 on 20.02.2015 and the case is pending for prosecution witnesses.

No.11490 of 2015 (3) dt.22-04-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Adhoc Additional Session Judge-VI, Patna in connection with Gardanibagh P.S.case No. 61 of 2014, corresponding to session trial no. 686 of 2014.
