JUSTICE ARUN KUMAR ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner, who is in custody, seeks bail in connection with Laxmipur P.S.Case No. 48 of 2016 (G.R.No. 466 of 2016) registered under Sections 147, 148, 149, 302, 307 and 364 of the Indian penal Code.

Prosecution case, in brief, is that there is omnibus allegation against all the accused and they indiscriminately assaulted the son of the informant by lathi and rod causing his death.

Learned counsel for the petitioner submits that there is no any specific allegation of assault against the petitioner. It is submitted that there is general and omnibus allegation and he has got no criminal antecedent and other co-accused namely Amrit

Patna High Court Cr.Misc. No.55007 of 2016 (2) dt.21-12-2016 2/2 Paswan and Sanjay Paswan, whose case stand on similar footing, have been granted bail earlier by a co-ordinate Bench of this Court by order dated 26.09.2016 passed in Cr. Misc. No. 27582 of 2016 and the case of the petitioner also stands on similar footing. Considering the aforementioned facts and circumstances, the petitioner, named above, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sri Amrendra Kumar, Judicial Magistrate, 1st Class, Jamui in connection with Laxmipur P.S. Case No. 48 of 2016 (G.R. No. 466 of 2016).
