The petitioner is accused in connection with Ara Town P.S. Case No. 511 of 2015, registered under Section 379 and 411 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that regarding theft of the motorcycle of informant, Munna Yadav, Ara Town P.S. Case No. 511 of 2015, under Section 379 of Indian Penal Code was instituted against unknown and in course of investigation, the theft motorcycle was said to be recovered by the Police, which was being driven by co-accused Tinku Kumar Singh and this petitioner along with Prem Kumar Pandey were

Patna High Court Cr.Misc. No.2530 of 2016 (3) dt.16-03-2016 2/2 found sitting on the motorcycle and on search, only Samsung mobile was recovered from the possession of the petitioner. Further submission is that, in fact, the petitioner has no concern with the said motorcycle and he was only a pillion rider. Further submission is that the petitioner is accused in two other cases, but in both the cases, he is on bail. The petitioner is in custody since 17.11.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur, Ara in connection with Ara Town P.S. Case No. 511 of 2015. Out of two sureties, one surety must be parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
