The petitioner seeks regular bail in connection with Purnahia P.S. Case No. 150 of 2020 lodged under Sections 307, 302, 120B and 34 of the Indian Penal Code, 1860 read with Section 27 of Arms Act.

Learned counsel for the petitioner submits that it is very clear from the F.I.R. that accused Gauri Shankar Maharaj and Neeraj Pathak had fired on the deceased and both were apprehended by the villagers. Learned counsel for the petitioner further submits that petitioner is not named in the F.I.R. and his named was transpired during investigation. Petitioner is in custody since 22.01.2021. He further submits that other coaccused namely, Ram Pravesh Rai and Rajeev Thakur were

Learned A.P.P. has opposed the prayer for bail. Considering the facts of the case and after perusal of the records as well as this aspect that petitioner is in custody since 22.01.2021 and charge has already been framed in this case whereas the trial has commenced also, let the petitioner above named, be granted bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-III, Sheohar in connection with Sessions Trial No.51 of 2021 arising out of Purnahia P.S.
