JUSTICE ASHUTOSH KUMAR ORAL ORDER 21-12-2021 Heard Mr. Umesh Chandra Verma, learned Advocate for the petitioner and Mr. Ram Priya Sharan Singh, learned Additional Public Prosecutor for the State.

The petitioner, who is the husband of opposite party no. 2, seeks bail in anticipation of his arrest in connection with Mahila P.S. Case No. 35 of 2020 dated 12.08.2020 instituted for the offences under Sections 498(A), 406 and 34 of the Indian Penal Code and 3 and 4 of the Dowry Prohibition Act, 1961. It is the stand of the petitioner that notwithstanding the accusation in the FIR, he is ready to settle the matrimonial dispute with his wife/opposite party no. 2.

Regard being had to the aforesaid stand of the petitioner, it is directed that in case the petitioner surrenders

Patna High Court CR. MISC. No.12207 of 2021(2) dt.21-12-2021 2/2 before the Court below within a period of six weeks, he shall be released on provisional bail, subject to the satisfaction of the Court below. Simultaneously, the opposite party no. 2 shall be noticed. On her appearance, ample opportunity shall be provided to the parties for negotiating the terms of settlement. Any settlement has to be on mutually acceptable terms. If the parties agree and decide to resolve the issue, the provisional bail granted to the petitioner shall be confirmed or else the law will take its own course.
