After some arguments, the learned Senior counsel for the petitioner seeks liberty to challenge the impugned order dated 20.09.2017, passed by the learned S.D.O., Arwal, whereby and whereunder the P.D.S. licence of the petitioner bearing licence no. 44 of 2007 has been cancelled, before the appellate authority.

Accordingly, the present writ petition stands disposed off with liberty to the petitioner to file appropriate appeal against the order dated 20.09.2017, passed by the learned S.D.O., Arwal and in case, an appeal is filed within a period of four weeks from today, the same shall be disposed off by the

Patna High Court CWJC No.13924 of 2018 dt.19-02-2020 2/2 appellate authority on merits within a period of three months of filing of such appeal. It is needless to state that in case, appeal is filed after lapse of a period of four weeks from today, the appellate authority shall be free to adjudicate upon the issue of limitation.

The present writ petition stands disposed off on the aforesaid terms.
