Petitioner seeks bail in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471, 472, 473, 120B/34 of the Indian Penal Code and Sections 66(C)/66(D) of the Information Technology Act.

Allegation against the petitioner and others is that they were indulged in collecting money from the candidates to manage scholars to appear, on their behalf, in the examination. Submission is that similarly situated co-accused Siyaram Singh was not allowed bail by a Coordinate Bench of this Court in Cr. Misc. No. 41446 of 2017 with liberty to renew the prayer after framing of charge or after three months whichever is

Patna High Court Cr.Misc. No.62578 of 2017 (3) dt.08-03-2018 2/2 earlier by order dated 20.12.2017.

It appears that several co-accused persons were allowed bail in the past vide Annexure-3 by different Coordinate Benches of this Court.

However, since the petitioner and some others were absconding in the case, their case was differentiated in the matter of grant of bail. Now, the petitioner is ready to cooperate with the trial.

Learned counsel for the Economic Offence Unit opposed the prayer for bail.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Economic Offence Police Station Case No. 07 of 2014, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
