2. The petitioner seeks bail in connection with Sandesh P.S. Case No. 225 of 2024 dated 27.07.2024, instituted for the offence punishable under Sections 103(1), 61, 3(5) of Bhartiya Nyaya Sanhita, 2023 & Section 27 of the Arms Act.

The prosecution case, in short, is that on 26.07.2024 at about 10 pm to 11 pm, co-accused, namely, Mithun Kumar called the grandson of the informant by making a phone call and thereafter, he did not return. On next day, the informant came to know about the dead body of his grandson lying near Dihri bridge. It is alleged that four months ago, Mithun Kumar and his four brothers also tried to kill his grandson.

4. Learned counsel for the petitioner submits that the

Learned counsel for the petitioner submits that the entire allegation is against co-accused Mithun Kumar. The petitioner is not named in the F.I.R. Only on the basis of confessional statement of Mithun Kumar, the petitioner has been made accused in this case. During investigation, no cogent material has been found against the petitioner. Lastly, it has been submitted that the petitioner is in custody since 28.07.2024 having no criminal antecedents. Charge-sheet has been submitted in the case.

5. Learned A.P.P. as well as learned counsel for the informant have vehemently opposed the prayer for bail of the petitioner. Learned counsel for the informant submits that coaccused, Mithun Kumar confessed that he along with the petitioner committed the said crime.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhojpur at Ata in connection with Sandesh P.S.
