JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 11.11.2014 in a case registered for the offences punishable under Sections 20(b), 22, 23 and 24 of the NDPS Act.

On secret information, one Mukesh Sah was apprehended with 275 grams of Charas who confessed that he was supposed to reach the consignment to Surendra Sharma when Surendra Sharma was apprehended along with Sanjay Das and the petitioner.

It is submitted by learned counsel for the petitioner that admittedly recovery has not been made from the petitioner nor the person, from whom recovery was made, has named the petitioner. The petitioner was simply apprehended since he was in the company of Surendra Sharma who was named by Mukesh Sah

Patna High Court Cr.Misc. No.2108 of 2016 (2) dt.19-01-2016 2/2 from whom contraband was recovered. Moreover, investigation has already concluded.

Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Addl. Sessions Judge, Motihari, East Champaran in connection with NDPS P.S. Case No. 78 of 2014 arising out of Palanwa P.S. Case No. 115 of 2014. (Dinesh Kumar Singh, J) Amrendra/- U T
