JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-03-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Lakhisarai P.S. Case No. 173 of 2014, registered under Section 364 and 120(B) of the Indian Penal Code.

The accusation is that on 27.03.2014 somebody called the son of the informant and kidnapped him. The informant disclosed the mobile number by which his son called and the ransom was demanded by the miscreants. Learned counsel appearing on behalf of the petitioners submits that it would appear from the case diary that the dead body was recovered and Post-mortem was done on 29.03.2014, thereafter the Police apprehended the petitioner

Patna High Court Cr.Misc. No.2024 of 2016 (3) dt.09-03-2016 2/2 mere on suspicion and got recorded the confessional statement on 12.04.2014 showing his involvement and conspiracy of murder of son of the informant after kidnapping, except the said confessional statement there is nothing on the record to show his involvement in this case. The petitioner is in custody since 03.04.2014.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Lakhisarai in connection with Lakhisarai P.S. Case No. 173 of 2014 (S.T. No. 211 of 2015). (Rajendra Kumar Mishra, J) manish/- U T
