The petitioner seeks bail in Barh P.S. Case No. 336 of 2014, registered for the offences punishable under Section 379 of the Indian Penal Code for theft of a motorcycle. Learned counsel for the petitioner submits that the motorcycle was recovered from the thatch house of the petitioner and the house is in joint possession. The petitioner has got no criminal antecedent and he has got three brothers namely, Indal Yadav, Laksho Yadav and Pappu Yadav. It cannot be said that the petitioner had kept the motorcycle in the thatch house and there is no evidence to this fact.

Considering the facts aforesaid the petitioner above named is directed to be enlarged on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.10184 of 2015 (2) dt.13-03-2015 2/2 Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Barh in connection with Barh P.S. Case No. 336 of 2014.
