The petitioner seeks bail in connection with Jurawanpur P.S. Case No.73 of 2021 registered for the offence punishable under Sections 272, 273, 328, 302/34 of the Indian Penal Code and under section 37(a) of the Bihar Prohibition & Excise Act.

The petitioner is said to have involved in the business of spurious liquor and on consumption of said spurious liquor five persons died and six persons became seriously ill. 4.

Learned counsel for the petitioner has drawn the attention of this Court to the order dated 20.09.2022 passed in Criminal Miscellaneous Nos.16708 of 2022 and 32689 of 2022, by which similarly situated co-accused Suresh Rai @ Suresh and Jaymod Kumar @ Jaymod Yadav have been granted

Patna High Court CR. MISC. No.5809 of 2024(2) dt.17-02-2024 2/2 bail by a co-ordinate Bench of this Court. The petitioner is in custody since 07.12.2023 and he has clean antecedent. 5.

Considering the fact that similarly situated co-accused persons have been granted bail by a coordinate Bench of this Court and also the fact that the petitioner has clean antecedent, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court, II-cum- Additional Sessions Judge, Vaishali in connection with Jurawanpur P.S. Case No.73 of 2021.
