====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 21-01-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Kazi Mohammadpur P.S. Case No. 439 of 2018, instituted for the offence under Section(s) 306/34 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is in custody since 15.10.2018 having clean antecedent. There is no evidence against the petitioner to show that he has committed the alleged occurrence.

It is alleged in the written report that after creating false I.D. of the deceased (daughter of the informant) on Facebook, this petitioner along with co-accused Rahul Kumar used to send vulgar messages, on account of which, the

Counsel for the petitioner submits that during investigation it has come that girl has died due to electric short circuit for which U.D. Case No. 05 of 2018 has been filed by the informant which is still pending.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Muzaffarpur, in connection with Kazi Mohammadpur P.S. Case No. 439 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
