JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 15-03-2016 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks bail in connection with Amba P.S. Case No. 77 of 2015 registered for the offences punishable under Section 414/34 of the Indian Penal Code and Section 2(E), 3(8), 15 and 18 of the Mahuwa Flower Act.

Allegedly, 375 Kg. of Mahua Flowers were recovered from white coloured Magic Vehicle bearing registration No. BR26F-7997 and the driver of the aforesaid vehicle managed to flee away from the place of occurrence. During course of investigation, it came to light that the aforesaid vehicle was being driven by Lal Bihari Paswan and the petitioner was the owner. Submission is of false implication and that the

No.2579 of 2016 (3) dt.15-03-2016 2/2 petitioner has already sold away the said vehicle to Lal Bihari Paswan which is evident from Para 45 of the case diary and that Lal Bihari Paswan has already been allowed bail vide Cri. Misc. No. 2177 of 2016 by another co-ordinate Bench of this Court and the petitioner is suffering in custody since 30.11.2015. In the facts and circumstances stated above, the petitioner, above named, is also directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad in connection with Amba P.S. Case No.

77 of 2015 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
